    Can we have some kind of time line that IV core/lobbying firm has knowledge of about S .9 and what might or will happen in March, just in another 15 days.

    If I call the IV number, can we get the future time line.

    My GUESS is that, it would take same time (if not more) for S9 as it would take for the IRAQ issue in Senate and House.

    I think if it wasn�t for the IRAQ fiasco we would have had our issues resolved a year back.

    And the start of S9 won�t happen till IRAQ issue is resolved/voted/rejected in senate or house.

    I think the biggest hurdle for S9 would be the request by Democrats to DUBYA to provide certain number of votes from Republicans. Democrats do not want to put there neck on the line for immigration issue. In other words if it comes to party line voting S9 is probably on the fence, and most likely to not pass.

    eb3_nepa's request is valid in the context that spouse of an L1 can take up any Job.. & the spouse of the proposed 'Blue Card" can take up any job.. why not a H4?

    I cannot agree with you more.

    On the other hand for those ones that say that we (H-4s) could apply for H-1B easily, it is not easy if you are not in IT. Some people said -although doesn't make much sense looking that L-1 and Blue card spouses would be able to work-, that if you do not want the H-4s to compete with average joes?, then an intermediate solution is to require a Bachellor degree minimum education requirement for getting the H-4s a H-4B (my new name for employment authorization), yes, dependend on the H-1B, if the H-1B is laid off the H-4 would still have the chance to apply for H-1B (without counting in the yearly quota) or leave the country after 6 months. Why should we get a F-1 visa?, most of us arrived highly educated.

    Most people do not seem to understand that the spouses of L-1s (legal) can work, and the spouses of Blue card holders (Agjobs) would be able to work, so leaving the H-4s out is DISCRIMINATION!

    Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.

    But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.

    It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.

    I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.

    Is there anyone else in the same boat? How long does it take for MTR to get processed?

    First of all Congratulations desi#### and thanks for continuing to support IV.

    Interesting discussion going on. Yes, I agree that most of us here are waiting for our GC and some of them go on to become US Citizens.
    I believe that becoming a citizen of any country is a person's choice, so let us not give desi### a hard time here.:o
    But I certainly do not think it is an 'achievement' to get a US citizenship, just because it implies indirectly it is an 'achievement' to let go off Indian citizenship. Nothing meant to offend you desi#### but it hurts when one reads such a statement somewhere deep inside the mind. But hey, as I said earlier, to each his own and noone should be judging others in their decisions.
    And it is not only Indians becoming US citizens every year. There are others too.
    Personally, even with all the advantages as stated above of being a US citizen, I will never let go of my Indian passport. Even if the authorities give it to me tomorrow in a lottery;) Never.
    Why? Because my identity, my rich heritage, my family roots, my parents, my culture everything is Indian and am proud of it. There are lot of sentimental and emotional attachments. I was going through the OCI articles today after reading this discussion.
    It is not exactly a dual citizenship. Some clauses are no voting rights! No Indian Passport!
    Getting a GC is another thing, but when I decide to go back after a couple of years, I would definitely want to retain my voting rights. ! I rest my case.

    I totally understand the emotional point of someone being want to be a Indian Citizen but I have to stress there is no other country in the world like U.S.A. This is the country where every human being is treated with utmost respect (don't try to show me exceptions - U.S. is a country where most of things are close to being perfect imaginatively), have freedom to say anything they want without getting intimidated and U.S is a country I believe will be the last bastion for humanity when terrosists/fundamentalists spread their tentancles and take over the world by force or other means (if not now probabbly in the next 100-150 years). Hypocrisy is relatively less. We Indians live in a dream world nurtured by the Indian politicians, who try to inject doses of patriotic non-sense into the masses while they themselves stove away million of dollars in Swiss banks. 70% of Indian population lives below poverty line and the educated masses of India think that their country will become a super power by 2020. Politicians like Mayawati play caste politics and dream of taking the top most post while our liberal media, without a wee-bit of shame, extends its highest support for them. Corruption is part of our daily life and we are part of the everyday corruption but we still find no fault in our society. Our population growth is beyond control while not a single politician is concerned about the stress it is going to create on our natural resources in the future. Our education system is in shambles but our great politicians fight for increasing the reservation system to different castes just for the sake of garnering more votes. And the list goes on. Alas���God help India.

    FYI: I am a Indian and haven't even started my greencard process, for the same emotional reasons you mentioned, intending to R2I soon. Given a choice and circumstances, I would have opted for U.S.C as "I have no hope for this world neither do I wish for it" - quoting Bhagawan Krishna from Bhagavad Gita.

    Took an infopass to find out why my spouse's case was not approved. A rude IO told that the background check was not completed yet, and it would take 30-60 days. Asked us to wait for 30-60 days. She looked and talked rude, so I did not ask her "if the background check was started or not". So, the question is how to expedite the background process, so that it will be cleared.

    Joke on Free-money-transfer was even highlighted in a movie. Its open secret as to how they offer free-money-transfer service.

    I advise you to close ICICI account and open another account with Federal credit unions. Before you do that, ask if you could use their debit cards in India to with draw money from ATM machines. The conversion rate you get via this method matches with the current rate and you would loose nothng. However, you can only withdraw upto 25 thousand rupees per day.

    ICICI deliberately delays the money transfer so that they can pick a day with lowest conversaion rate. Again the conversion rate they display on their site is off by almost a rupee from the live conversion rate.

    All banks are well protected from laws and you can't do anything about it.

    Why cannot they just say it?. Why can’t they say that it will take 2 days to 22 days or 222 days to transfer the amount?, if someone needs to send money due to an emergency, they do it thinking that the money will be transferred in two or three days, a week maybe…

    Beats me! I don't know why they (the indians) do that. They make agressive promises and then fail to meet them. They should adopt the US business style of promising results in 5-7 business days and then deliver in 3-4 days. It then becomes the customer's headache to plan accordingly and they (the customers) are in fact delighted to get the work done in 3-4 days.

    (Never mind the fact that the work would actually take them less than 1-2 bus day ;))

    I have visitor insurance for my mother who is visiting us. Recently she developed some symptoms. The insurance company told us that since the symptoms were due to a condition that originated while she was in India, it is a pre-existing condition.

    My advice to you all is to get a physical checkup for your elderly parents in India once in a while. At least you would know if there are any issues which come with old age and you can take an insurance covering those existing conditions.

    I agree, there is slim chance that 5882 could pass, we must do our best and not let it slip out of our hands. Keep writing and calling. At this rate EB 3 I will not move more than a couple of months per year. The new visa allocation policy will retrogress EB3 ROW too and as EB3 ROW starts getting retrogressed there will be less and less available for EB3 I.

    If you can porting to EB2 is always a better choice.
    For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.

    HR 5882 is the only solution for all atleast for this year.
